These terms outline your rights and responsibilities when using the WhoCan app. Please read them carefully to ensure a smooth, secure experience.
Introduction
Welcome to WhoCan! By creating an account and using the WhoCan app, you agree to these Terms and Conditions. This agreement is between you and WhoCan (“the Company”) and governs your access to and use of the services available through our platform.
User Accounts
Registration Requirements
All users must provide accurate, complete, and current information when signing up. This helps ensure trust between users and supports reliable transactions and communication.
Account Security
You’re responsible for keeping your account credentials confidential. Any activity under your account is your responsibility. Please notify us immediately if you notice any unauthorized use.
Services Offered
Platform Functionality
WhoCan acts as a connection point between people seeking services (“Requesters”) and those offering them (“Providers”). The company does not deliver or receive services directly — it provides the tools for both parties to find, communicate, and complete service transactions.
Transaction Management
Users can post requests, respond to listings, schedule services, and make or receive payments within the app.
Location Access
With your permission, we use real-time location data to match you with nearby users, verify meeting points, and enhance trust and safety on the platform.
Requirements for Providers
To receive payments for services rendered, all Providers must set up and connect a valid Stripe account through the WhoCan platform. This step is required to ensure secure, direct payouts and compliance with financial regulations. Without linking to Stripe, Providers will not be eligible to accept payments through the app.
User Conduct
Compliance
Users are expected to follow all applicable laws when using WhoCan.
Prohibited Use
Any behavior involving fraud, abuse, harassment, or illegal activities is not allowed. Such actions may result in the suspension or termination of your account.
Payments and Refunds
Service Fees
WhoCan collects a platform service fee from each transaction. All payments are processed through Stripe, and users are subject to its terms and conditions.
Cancellations
Requesters may cancel services through the app. Refunds are available if cancellations happen with sufficient notice.
Late cancellations may incur a partial fee to compensate the Provider.
If a Provider cancels or fails to show up without valid reason, the Requester will receive a full refund, and the Provider may be flagged for review.
Penalties for Frequent Cancellations
Providers with repeated cancellations without justification may be suspended or permanently removed from the platform. If removed, they may appeal. If the appeal is denied, any pending funds will be released after a short waiting period upon request via customer support.
Frequent Requester Cancellations
Requesters who cancel multiple bookings within a short timeframe may face temporary restrictions on new service requests.
Non-Compliance Refunds
If a completed service does not meet the agreed expectations, Requesters can submit a complaint within a reasonable time after service completion. Valid complaints may result in a partial or full refund.
Dispute Resolution
If issues arise between users, WhoCan encourages amicable resolution. If that fails, our support team will mediate based on the app’s policies.
Refund Timelines
Approved refunds are processed within a standard time frame and returned to the original payment method. Time may vary depending on your payment provider.
Limitation of Liability
Role of WhoCan
WhoCan is only a platform that connects users. We are not responsible for the services provided or requested. All responsibility lies with the individual users who enter into service agreements.
No Endorsements
We do not endorse or guarantee any specific Provider or Requester. Users should make informed decisions based on reviews, ratings, and verification tools provided in the app.
Service Risks
WhoCan is not liable for injuries, damages, or losses that occur during service interactions. Users are encouraged to exercise caution and take necessary safety measures.
Data Protection
We prioritize the security of your data, but no system is entirely immune from breaches. If a breach occurs, we will take appropriate steps to minimize harm and notify affected users as required.
Legal Cooperation
We may disclose user information to law enforcement if legally required. This is necessary to uphold the law and protect the integrity of our platform.
Intellectual Property
All app content, including software, graphics, and design, is the property of WhoCan or its licensors. You may not reuse or reproduce any part of the app without written permission.
Account Suspension and Termination
WhoCan reserves the right to suspend or permanently deactivate any account that violates these terms, engages in harmful conduct, or disrupts the user experience for others.
Updates to Terms
These Terms and Conditions may be updated from time to time. Users will be notified of changes within the app. Continued use of WhoCan after updates indicates your acceptance of the revised terms.
Governing Law
These terms are governed by the laws of the State of Maryland, United States. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in that region.
